I think it was Aerisfilk who sang the spoofed songs. I want the one she sang for me... LOL The one that starts out, "Oh my god, Tifa look at his sword..." I WANT THAT!!!! An mp3 would be sweet!!

Oh man that song was great :D  "His sword, it's just so....BIG!" Bwaha, man, thank god you were there...just wouldn't of been the same without a cloud to be up there with her. If anyone could find an MP3 of that I'd love it as well ^_- heheh

*laughs*  You were the first Cloud with the guts to get up on stage with me.  I've had them wave their swords around before and dance in the aisles, but that was my first stage-crashing by a Cloud cosplayer, and it rocked.  I figured you deserved a smooch just for being that brave.

Might I add if your provider does not accept MP3 sized e-mails you may want to test out gmail at gmail.google.com
I believe it holds 1 gig of space, and it's free ^_^

Do you know how if a big named singing group tours (let's say the Rolling Stones)....no matter what, they have to do "(I can't get no) Satisfaction" even if the fans have heard it many times before and they've sung it so many times?

In my opinion, it's the exact thing with "Midgar Booty" by FilkAeris.  I invited her to sing the song at Kumoricon 2003 and again at Kumoricon 2004.  And you know what, if she'll do it again, I'll happily have her back to sing a new song and what I tease her and call "Her First Hit," again next year.  She improves as a performer everytime she does it (and she was great to start out with)!  

10 years from now, once a lot of this year's convention is forgotten, "Midgar Booty" will be one of those memories that people won't forget.

*laughs*  Yeah, I can see it now, Naboo-san.  Ten years from now, Kumoricon will be the biggest con on the west coast, and I'll have concert lighting and one of those cool spaceship things that lowers rock stars ftom the ceiling with a smoke machine inside as I sing...Midgar Booty, for the five millionth time.  ^_^

Meh.  Luckily, I seem to be as incapable of getting tired of that song as the "fans" are.  (All joshing about being a rock star aside, I still can't quite wrap my brain around the idea of having fans.  Wonder if I'll end up like Bakazoku?  That would be...interesting.)

That was one of the best shows I've seen in a while.  :P  KumoriCon is gonna be significantly bigger each year. especially with performances like FilkAeris's.  Next year is gonna rock.

I think for next year's Kumoricon, I think there should be a CD Single with the Mambo no jutsu and Cloud Strife songs (with and without vocals) sold at the Dealer's room for a nominal fee. It would sell like hotcakes, I tell ya.

I know the legalities behind putting out a version of a song for a fee when the music is also rerecorded, (It's just a matter of letting the publisher know in advance and making sure the song writer gets their 'cut'.

But, in these two cases, the prerecorded background music that has it's own rules reguarding it's use is the big sticking point.  Most Karaoke CDs have some sort of disclaimer about selling your version of the song using their background music.

In order to be legal, new background music would have to be recorded, or permission in writing would have to be given from the Karaoke company (or each Karaoke company).  

(Believe me, I'd be first in line for a CD and I'd get it autographed, but if the con is involved, we need to keep it legal).  The con really couldn't stop someone from selling a few of their belongings from their rooms, but we have to follow the law on anything mentioned or taking place in con space.

Well, I know I would have to get someone to mix new backup tracks for me...but under the Fair Use law, I don't have to give the original songwriters a "cut" of anything.  (I know because I looked it up on Weird Al's site--he's an inspiration and a good source of legal info re: parodying!)  However, it is polite to ask the songwriter nicely before selling anything based on work by them.

Hmm...I wonder how one would go about contacting Sir Mix-A-Lot and Lou Bega...?

You are dead on about not needing permission to redo a song and make any changes to it you'd like (as Al says, it's nice to have permission though).  Sir Mix Alot was actually based in Seattle last time I checked.

When a Weird Al record is sold, whoever holds the license for the song (BMI, ASCAP), gets a small fee that goes to the songwriter/writers.  You wrote the words, but the person that wrote the tune needs to get paid.  That's how they make their money.  (Radio stations also play a few cents per spin of a record...when one of Al's songs is played, the people listed as the writers of the song get the money.  I just checked my copy of "Running with Scissors."  The song "The Saga Begins" is listed as being written by Don McClain (BMI) with Lyrical  Adaption by Al Yankovic (also BMI).  I do not know how the money is split in this case.

It's fair use to do exactly what your doing (as long as the venue has paid their ASCAP and/or BMI bill), but it's totally out of the realm of fair use when you make money from it without notification (does not need to be permission, just advanced notification) and the very small fees that go to the publisher per unit.

I guess I'm going to be hitting the legal sites tonight so I can have legal codes and such to back up everything I've said.  I've spent too many years filling out ASCAP playsheets for the radio station to not be extremely familiar with it.

Cool, thanks for the heads up!  It's good to know these things beforehand.  I would like to put together a "real" CD with several songs one of these days and sell it at cons, so I'll need to have my legalities straight first.

Here's the data I was talking about.  Don't forget about permission to use the Karaoke Version or getting your own background recorded.

What if I have my OWN version of a song (cover song) and I want to put it on my CD?

Any artist/band has the right to record and release their own version of any previously released song they like. By law, the original writer/publisher of the song has to grant a compulsory mechanical license to the artist/band that wants to cover the song. The artist/band covering the song must pay a fee of 7.55 cents per song per copy manufactured to the original publisher/writer of the song. This is done through www.songfile.com, a division of the Harry Fox Agency (an agency that represents and administers mechanical licenses for publishers).

For example, if your band has a cover of "You Really Got Me" by The Kinks, you need to pay the compulsory mechanical license fee of 8 cents per copy you manufacture to the publisher/writers of that song.
So say you have two cover songs on your CD, and you are making 2000. Here's what you need to pay:
8 (cents) x 2 (songs) x 2000 (copies) = $320.00

You should be able to find and get the license for most songs on www.songfile.com.
If your request comes up as "unavailable for licensing", all that means is that the Harry Fox Agency does not represent that particular publisher/songwriter. You will need to seek out the publisher of the song (just look in the credits) and contact them, telling them you need a compulsory mechanical license for a song and who do you need to send the check to? Once again, they HAVE TO grant the license by law.

Identify the song you wish to license:

1. Access Songfile via the Internet at www.songfile.com
2. Using the song search engine, on the Songfile home page, enter the title of the song you wish to license.
3. Select the song, from the search results, by "clicking" on the bull's eye.
Several yellow buttons will appear on the top right of your screen.
Select the LICENSE button.
4. Select "Make a Recording" from the "WHAT LICENSE DO YOU NEED?" page.

Complete the license request application:

5. Answer the four (4) questions on the "Make a Recording" page and submit.
6.The "Mechanical License Request – Restricted Quantities" screen requires you to complete information pertaining to your use of the song.
- Fill in the information for your artist, album, and label.
- Play time should relate to the duration of the song you are licensing.
- "Number of recording" must be within the allowed range (currently 500 - 1000).
- Select the configuration being manufactured.
- Digital download recordings are not available for licensing.
- Continue your request.
7.The next screen is the second part of the previous screen.
- Complete the address and contact information on the next screen. This is very important in the event that we need to reach you. Please be certain that your e-mail address is correct. This will be used to confirm your request and send you the license.
- Fill in all the information in the Payment Information section.
- PLEASE NOTE THE DOLLAR AMOUNT THAT WILL BE CHARGED TO YOU BEFORE YOU CLICK ON "PROCESS ORDER."
8.The following screen will give you the option of continuing if you need additional Mechanical Licenses. If you are licensing more than one song during the same session, the system will retain important information you entered previously, as well as your personal and encrypted credit card information. This will save you the time from re-entering your information.

If the publisher/writer is represented by Harry Fox, you will be able to obtain the license immediately by giving them a credit card number (don't worry, it's safe, we've done it a bunch of times). Make sure you print out the license, we will need it for the manufacturer.

If you don't know who the original publisher or writer of the song is, or if you don't know how to get ahold of them this is what to do:

If the song was written AFTER 1978, go to www.loc.gov/copyright and do a search under Documents & Registration.

Here is Fair Use in your context but it really isn't important.  Fair use just means you can do it, it dosn't mean you can do it for free:

Under Federal Copyright law, the owner of a copyright has certain exclusive rights to the use of their copyrighted works, including the right to make derivative works - works that are based upon or use elements of the original, but incorporate new elements or changes.

One exception to this exclusive right has been the right of others to use part of the work for purposes of criticism, comment, news reporting, teaching, scholarship or research which would be considered a "fair use." Such fair use has traditionally included the right to parody or satirize the original work as such use has a public benefit of comment and criticism, and because the parody, generally, does not compete with the original, as it appeals to a different audience.  (There is a very important case involving 2 Live Crew that backs up musical fair use).

I'm rather ignorant of the laws concerning this, but they seem to be a bit of grey area.  But then since you're just using the bg music and using your own lyrics, it may be easier.   Mainly mentioned this because, while I was in the military, I saw music video that was gesture(sp?) of support for the troops.  However, I remember looking at the author's website, and he said he had to take it down as the song owner's sent him a letter to stop.  Overall, I think it just highlights what naboo was saying in that you want to make sure its all legal.

On another note, I would agree its starting to get you your own fan following, flikaeris.   I think its because its so original(to my knowledge) and well done, that it ends up quite popular.  Plus the fact you're a very good cosplayer as well.  I was able to finally see your angel haku cosplay at obsessedwithanime website(and in the pose I wanted to do), and I have to say its very well done.

Oh, believe me, if I wasn't determined to make sure everything was absolutely legal, I would have had a (probably questionable) CD out long ago.  ^_^

The reason I went out of my way to get you the EXACT procedure on how to do this is that I would love to see you put out a FILK CD that could be sold at Conventions and mail order.  I'm a big fan and I know something that will have crowd appeal when I hear it.

(Want to hear some "wacky" rules that exist for music in a public place?  Have you ever noticed that many stores play music on a home stereo or boom box?  That is because if they sent the music through built in speakers, they would have to pay for the use of the music, even if it was just a radio turned to a local station.  ASAP sends people all around the country looking for little mom and pop stores to 'catch' breaking this law.  This has been going on for 25-30 years too, long before any of the song downloading law suits.)
